Planning Application No. 22/02324/CONR

Variation of Condition 1 (Approved Drawings) and Removal of Conditions 5 (Railings) and 6 (No Roof Terrace) attached to planning permission ref. 19/04864/HSE for the construction of a first floor, single/two storey front/side extensions to form a two-storey dwelling. Construction of a rear roof extension with installation of 4 front and 2 roof lights to each side roof slope and associated alterations.

This planning application has been submitted as a result of residents complaining to Planning Enforcement that following refusal on appeal for retrospective planning application No. 21/03937/HSE no corrective action has been taken. Planning enforcement case no 21/00066/NBI refers and remains open. Despite numerous requests, Planning Enforcement has failed to provide any updates. Residents have now been in correspondence with the Council on this matter for 2 years.

This submission is basically the same as retrospective planning application No. 21/03937/HSE with the main difference being that the applicant has now acknowledged that he has to remove the balcony and screening to the “loft floor.” However this submission has failed to remove the balcony and screening to the first floor. This is unacceptable as reasons 1 and 2 in the planning department’s refusal letter dated 28th October 2021 for retrospective planning application No. 21/03937/HSE quite clearly requires their removal. This was confirmed by the Planning Inspectorate Appeal Decision Ref: APP/L5240/D/21/3289019 dated 29th April 2022.
