Enlargement of the existing rear dormer to the main roof including recessed balcony.

This planning application is to remove the unauthorised balcony to the rear dormer and construct a smaller balcony.

An enforcement notice was finally issued on 20/4/23 to remove the second floor (loft room) projecting platform from roof dormer and obscured glass screen, because the first floor and second floor terrace and screening would be detrimental to the amenities of the occupiers of 80 and 84 Hartley Down resulting in an unacceptable loss of privacy.

Planning Application 22/02324/CONR was finally refused on 5/5/23. In this application the householder had accepted that he must remove the balcony to the “loft floor” and install the metal balustrades in accordance with the planning consent. It is therefore very disappointing that he is now applying to have a smaller balcony in this planning application.

The proposed smaller balcony is still unacceptable as reasons 1 and 2 in the planning department’s refusal letter dated 28th October 2021 for retrospective planning application No. 21/03937/HSE quite clearly requires their removal. This was confirmed by the Planning Inspectorate Appeal Decision Ref: APP/L5240/D/21/3289019 dated 29th April 2022.
